Terms of Service

1. Acceptance of Terms

By creating an account or using ListingVid.pro™ (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and ListingVid.pro™, operated by Dave Brock, REALTOR®, Tulsa, Oklahoma.

2. Eligibility

You must be at least 18 years of age and a licensed real estate agent, broker, or authorized representative of a real estate brokerage to use this Service. By using ListingVid.pro™, you represent and warrant that you meet these requirements and that your use complies with all applicable laws and regulations in your jurisdiction, including MLS rules and the Fair Housing Act.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Ownership of Your Content

You retain full ownership of all property photographs, listing data, and other content you upload to the Service (“Your Content”). By uploading content, you grant ListingVid.pro™ a limited, non-exclusive license to process, store, and transform Your Content solely for the purpose of generating your listing videos.

You represent and warrant that you have all necessary rights, licenses, and permissions to upload and use Your Content, including any MLS-sourced photographs, and that doing so does not violate any third-party rights or applicable MLS rules.

5. License to Use Generated Videos

Videos generated by the Service using Your Content are licensed to you for use in your real estate marketing activities, including social media, websites, email campaigns, and client presentations. This license is personal, non-transferable, and limited to your brokerage and listings.

You may not resell, sublicense, or redistribute generated videos as a standalone product or service to third parties.

6. Acceptable Use

You agree not to:

• Upload content you do not have the right to use
• Use the Service for any listing or property you are not authorized to market
• Produce content that violates the Fair Housing Act or any fair housing regulations
• Attempt to reverse-engineer, copy, or replicate the Service
• Use automated scripts or bots to access the Service in a manner that exceeds your plan limits
• Use the Service to generate misleading, fraudulent, or deceptive marketing materials

7. Fair Housing Compliance

You are solely responsible for ensuring that all listing videos you create comply with the Fair Housing Act (42 U.S.C. § 3604) and all applicable state and local fair housing laws. ListingVid.pro™ provides a video creation tool and does not review, approve, or guarantee the compliance of any content you create. Any AI-generated script content must be reviewed by you before publication.

8. MLS Rules Compliance

Your use of MLS photographs and listing data in the Service is your responsibility. You must ensure your use complies with the rules of any Multiple Listing Service of which you are a member, including any restrictions on third-party use of MLS data or images. ListingVid.pro™ is not affiliated with or endorsed by any MLS.

9. Subscription Plans & Billing

ListingVid.pro™ offers subscription plans with monthly billing processed by Stripe. Your subscription renews automatically until canceled. Plan limits (videos per month, export resolution, features) are described on our pricing page. Overages are not automatically charged — you will be restricted until the next billing cycle or until you upgrade.

Refunds: We do not offer refunds for partial months. If you cancel mid-cycle, you retain access until the end of the paid period.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

ListingVid.pro™ makes no representation that listing videos created using the Service will result in increased listing traffic, faster sales, higher sale prices, or any other business outcome.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LISTINGVID.PRO™ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice. You may cancel your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Tulsa County, Oklahoma.
